1. Subject

These general terms and conditions of sale apply to the purchase of products by users who qualify as 'consumers' (i.e., individuals who purchase one or more products for purposes not related to their entrepreneurial, commercial, craft, or professional activity, pursuant to and for the purposes of the so-called "Consumer Code") through the e-commerce site www.chicshoes.eu, owned and managed by “Chic Shoes di Marzia mango srls” (VAT No. 08926021216; Rea NA-995516 – share capital Euro 2,900.00), with registered office in Naples (80125), at via Caio Duilio, no. 45; cell +39 3271834548, certified email (p.e.c.) chicmarziachiarasrls@legalmail.it (hereinafter, for brevity, Chic Shoes), which is responsible for the sale of the products as the 'seller'.

Any communication from the consumer connected and/or related to the purchase of the products – including any reports, complaints, requests concerning the purchase and/or delivery of the same, the exercise of the right of withdrawal, etc. – must be sent to the seller at the contact details and in the manner indicated on the website www.chicshoes.eu and, in any case, to the email address chicshoescm@gmail.com.

Each purchase is governed by these general terms and conditions of sale in the version published on the aforementioned Site at the time the order is placed by the consumer.

If one or more sales are made to a subject who does not qualify as a consumer according to the meaning of the aforementioned legislation and as specified above, i.e., by a professional – defined here as any natural or legal person who places an order in the exercise of their entrepreneurial, commercial, craft, or professional activity – these general terms and conditions of sale shall still apply but, by way of derogation from what is provided therein:

(a) the non-consumer buyer will not be granted the right of withdrawal as provided for in the shipping and returns section, and in the event of disputes, the so-called consumer court referred to in art. 8 below will not have jurisdiction;

(b) the non-consumer buyer will not be able to benefit from the product warranty referred to below;

(c) the non-consumer buyer will not be granted any other protections provided herein in favor of the consumer, which reflect or comply with mandatory legal provisions;

(d) the sales contract concluded between the seller and the buyer will be governed by Italian law, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods – 1980 Vienna Convention.

At the time of transmitting the purchase order, the Consumer accepts that the confirmation of the information relating to the order placed, which will also contain the link to these general terms and conditions of sale, be sent to them via email to the address provided by them during registration on the aforementioned website or during the purchase process.

To be able to make purchases through the site www.chicshoes.eu, the buyer must be of legal age (over 18 years old).

The Seller reserves the right to modify these general terms and conditions of sale at any time, at its own discretion, without the need to provide any prior notice to users of the chicshoes.eu Site. Any changes made will be effective from the date of publication on the aforementioned Site and will apply only to sales concluded from that moment on.

2. Product Characteristics

The products sold by Chic Shoes through the aforementioned Site are the products present in the electronic catalog published on chicshoes.eu at the time the order is placed by the buyer and are sold with the characteristics described on the aforementioned Site and according to these general terms and conditions of sale in the version published on the Site itself at the time the order is sent, to the exclusion of any other condition or term.

Chic Shoes points out that the images and descriptions of the products published on the Site reproduce the actual characteristics of the products themselves as faithfully as possible. It is understood that such images and descriptions may not be perfectly representative of the products and must, therefore, be considered indicative and subject to normal tolerances.

The products for sale on chicshoes.eu, their prices and/or characteristics are subject to change without notice. Before sending the purchase order pursuant to point 3 below, the buyer is invited to verify the final sale price.

It is also noted that the prices indicated in the electronic catalog published on chicshoes.eu are to be understood as including VAT.

3. How to Purchase Products – Perfection of Each Individual Purchase Contract

The presentation of products on chicshoes.eu, which is non-binding for the seller, represents a mere invitation to the consumer to formulate a contractual purchase proposal and not a public offer pursuant to art. 1336 of the Italian Civil Code, with the seller retaining full discretion regarding the acceptance of any proposals formulated.

The purchase order transmitted by the buyer to the seller through the chicshoes.eu site acts as a contractual proposal and is governed by these general terms and conditions of sale, which form an integral part of the order itself, and which the buyer, by transmitting the order to the seller, is required to accept in full and without any reservation. Before proceeding with the purchase of products by sending the purchase order, the user will be asked to carefully read these general terms and conditions of sale and the information on the right of withdrawal, and the user/buyer is hereby invited to print a copy or save or reproduce a copy for their own personal use.

The purchase order is accepted by the seller by sending to the buyer, at the email address declared by them at the time of registration on the chicshoes.eu Site or at the time of transmitting the order (in case of non-registration on the Site), an email confirming the order placed and with which Chic Shoes, having verified the actual payment for the goods, will send the summary of the order placed and the description of the characteristics of the ordered product. The buyer expressly accepts that the execution of the contract by the seller will begin at the time the price of the purchased product(s) is credited to the seller's current account. Every product purchase contract is considered concluded at the moment the buyer receives the order confirmation from the seller via email as specified above.

The buyer's order, the seller's order confirmation, and the general terms and conditions of sale applicable to the relationship between the aforementioned parties will be archived electronically by the seller in its computer systems (for 26 months), and the user may request a copy by sending an email communication to the seller at the address chicshoescm@gmail.com.

The price of the products is that indicated on the chicshoes.eu site at the time the order is placed by the buyer. Prices include standard packaging costs, VAT (where applicable), and any indirect taxes (where applicable).

4. Product Selection and Purchase Procedure

Purchasing products on the Site can be done directly without prior registration.

Registration on the site is free and will entitle the user to access special reserved promotional conditions for future orders, check their order history, and manage their personal data.

To register on the chicshoes.eu site, the user must fill out and submit the appropriate form by entering the requested data (for example, name, surname, address, email, and phone number). Registration will then be confirmed by sending a confirmation email. The registration credentials must be used solely by the user and may not be transferred to third parties; the user undertakes to ensure their secrecy. The user guarantees that the personal information provided during the registration procedure on the Site is complete and truthful and agrees to keep Chic Shoes harmless and indemnified from any compensation obligation and/or penalty and/or damage that it may incur as a result of the user's violation of the rules governing registration on the aforementioned Site and the purchase of products thereon.

Products presented in the catalog of the chicshoes.eu Site may be purchased by the user selecting them and adding them to the virtual shopping cart. Once the selection of the chosen products is finished, to continue with the purchase of the products added to the cart, the buyer will be asked to: (a) register on the chicshoes.eu Site by providing the requested data, or (b) log in if already registered, or (c) simply provide their data in order to complete the order and, therefore, proceed with the finalization of the contract. If the data indicated in the order are different from those provided during registration on the Site, the buyer must confirm their data (indicating, for example, their name, surname, etc.), as well as the delivery address for the selected products (and possibly the different name of the recipient, if different from the buyer), the billing address, and a telephone number where they can be contacted for any communications regarding the purchase made. The buyer will then be able to view a summary of the order to be executed, the contents of which they can modify, and finally, they will be asked to proceed with the purchase, which will thus be definitively sent to the seller. The buyer will also be asked to choose the payment method from those available. If the buyer decides on the immediate payment method by credit card or PayPal, they will be required to communicate the relevant data via a secure connection. Chic Shoes does not have access to and does not store the credit card data used for the payment of the products, and, if made through the PayPal system, the buyer will be directly redirected to www.paypal.it and will perform the payment according to the procedure provided and regulated by PayPal, to which reference is made, specifying that the data entered on that site will be processed directly by the latter.

Alternatively, the user may opt for: (a) payment by bank transfer, in which case the instructions and bank details of Chic Shoes will be provided at the time of purchase; (b) payment on delivery, in which case the balance of the goods must be paid exclusively in cash: the courier will not accept any type of check.

5. Seller's Legal Warranty of Conformity, Reporting Conformity Defects, and Warranty Interventions

Pursuant to and for the purposes of European Directive 44/99/EC, Legislative Decree 206/2005 and subsequent amendments (the so-called Consumer Code), the seller guarantees to the buyer that the products will be free from design and material defects as well as compliant with the descriptions published on the chicshoes.eu Site for a period of 2 (two) years from the date of delivery of the products themselves. The application of any warranty is excluded in the event of use of the product not in accordance with that appropriate for the product and the instructions/warnings provided by the seller or reported in the relevant illustrative documentation, tags, or labels.

On pain of forfeiture of this warranty, the consumer has the burden of reporting any defects and non-conformities within no more than 2 (two) months from discovery, by sending a communication to the email address chicshoescm@gmail.com, indicating therein the defect and/or non-conformity found as well as relative photographic documentation.

Following receipt of the request and the relative documentation, the seller will verify and evaluate, by means of appropriate checks, the defects and non-conformities thus reported. The consumer will be entitled to the repair or replacement of the product, where this is possible in consideration of the product's availability, and unless the replacement or repair proves excessively burdensome for Chic Shoes in consideration of the value that the product would have if there were no lack of conformity, the extent of such defect, and the possibility that the alternative remedy could be carried out without significant inconvenience for the consumer.

Should the seller be required to refund the price paid to the consumer, the refund will be made, where possible, using the same payment method used at the time of purchase or by bank transfer. It will be the consumer's burden to communicate to the seller, at the time of requesting the return or via email to the address chicshoescm@gmail.com, the bank details for the execution of the transfer in their favor.

6. Consumer Data and Privacy Protection

In order to proceed with registration, order submission, and therefore the conclusion of the contract, the buyer must provide certain personal data requested through the chicshoes.eu site, which will be recorded and used by the Seller in accordance with and in compliance with the legislation referred to in Legislative Decree no. 196/2003 and subsequent amendments (the so-called Privacy Code) to execute each purchase made through the Site and, upon their consent, for any further activities as indicated in the specific privacy policy provided through the Site.

For any further information on how personal data is processed, please refer to the Privacy Policy and Cookie Policy sections, which the buyer declares to have read and accepted together with these General Conditions of Use.

7. Copyright

All texts, images, and trademarks appearing on the site www.chicshoes.eu are protected by copyright and intellectual property laws; therefore, any unauthorized use will be prosecuted pursuant to and for the purposes of the legislation in force in the matter. The user who has a personal website on the Internet and wishes to include, for personal use, a direct link to the homepage of the chicshoes.eu site on their website must request authorization from Chic Shoes, and in such case, it will not be an implicit affiliation contract. Furthermore, any hyperlink to the chicshoes.eu site using the technique of framing, deep-linking, in-line linking, or any other deep linking technique is in any case prohibited.

8. Applicable Law and Competent Court

The contract concluded between the seller and the consumer pursuant to these terms of sale will be governed by and interpreted in accordance with Italian law and, in particular, Legislative Decree 206/2005. Disputes between the seller and the consumer arising from the contract between them thus regulated will be referred to the judge of the place of residence or domicile of the consumer, according to the aforementioned meaning and as per the consumer code, if located within the territory of the State. In all other cases, jurisdiction will be assigned exclusively to the Court of Naples.
