The shipment is carried out by “Chic Shoes di Marzia Mango s.r.l.s” (hereinafter, for brevity, only Chic Shoes), as the owner of the website www.chicshoes.eu, from the moment in which the consumer receives the order confirmation email (which, as specified in the ‘Terms of Sale’ section, is sent once receipt of payment by Chic Shoes has been verified), usually within 2 (two) business days if the destination address is in Italy, or, if the destination address is within foreign countries belonging to the European Union, within 7 (seven) business days, and in the case of a destination country outside the EU, within 10 (ten) business days.
Chic Shoes undertakes to do everything in its power to respect the delivery times, which it reserves the right to indicate at the time of product shipment (should the customer request it), and in any case, within 30 (thirty) business days.
In the event of non-execution of the order by the seller due to any unavailability, even temporary, of the purchased product, the seller will provide written communication to the buyer in the same manner and will proceed to refund any sums already paid for the product.
If the packaging or wrapping of the ordered products should arrive at their destination clearly damaged, the buyer is invited to refuse delivery by the carrier/shipper or to accept the delivery "subject to checking".
2. Shipping costs, taxes and duties
The price of the products, as indicated in the terms of sale, is that indicated on the chicshoes.eu website at the time the order is placed by the buyer. The prices include standard packaging costs, VAT (where applicable) and any indirect taxes (where applicable).
Shipping costs will be indicated when the order is placed. If the products are to be delivered to a country not belonging to the European Union, the total price indicated in the order and reiterated in the order confirmation is intended to include indirect taxes and is net of any customs duties and any other sales taxes, which the buyer hereby undertakes to pay, if due, in addition to the price indicated in the order and confirmed in the order confirmation, in accordance with the legal provisions of the country in which the products will be delivered. The user/buyer is invited to inquire with the competent authorities of their country of residence or of destination of the products, in order to obtain information on any duties or taxes applied in the country of residence or destination of the products.
Failure by the buyer to be aware of the aforementioned costs, charges, duties, taxes and/or levies at the time of sending an order to the seller cannot constitute grounds for termination of the contract and cannot in any way constitute a source of charging the aforementioned costs to the seller.
3. Right of withdrawal
The consumer is granted the right to withdraw from the contract concluded pursuant to these general terms of sale, without any penalty, within 15 (fifteen) calendar days from the delivery of the product or, in the case of the purchase of multiple products delivered separately with a single order, from when the last product was delivered.
To exercise the right of withdrawal, simply ship the items to the following address: Via Risorgimento, 69 – 80126 Naples, including a sheet inside the package with the following data:
name, surname, order number, reason for the return and IBAN if cash on delivery was chosen as the payment method at the time of purchase.
IMPORTANT:
All shipping costs are non-refundable; only the value of the items will be refunded.
The risks and direct costs of returning the products will be borne by the consumer, unless the product is being returned because it arrived damaged, in which case the costs are borne by Chic Shoes and subject to any subsequent verification regarding the causes of the damage suffered by the product. If the returned goods are found to be worn, damaged (for example with signs of wear, abrasion, scratches, deformations, detachment, etc.), not complete with all their elements and accessories (including labels, laces and any other attached elements), original packaging and wrappers, and the warranty certificate, where present, Chic Shoes reserves the right not to proceed with the refund. Chic Shoes will be forced to refuse returns communicated or sent back late, or returns of products that are not in the same condition in which they were received.
In case of withdrawal, Chic Shoes will refund the payments received within 14 (fourteen) days from the moment it is informed of the consumer's decision to withdraw from the contract, without prejudice to the right to withhold the refund until receipt of the returned goods and subject to verification of the same. These refunds will be made using the same payment method used by the consumer at the time of purchase in the case of advance payment via PayPal or Credit Card, while they will be credited via bank transfer with the IBAN previously communicated by the consumer in the case of payment on delivery, unless the consumer requests the refund via a different credit method or wishes to receive a promotional code for the amount of the refund to be used within 14 days.
CASES IN WHICH THE RIGHT OF WITHDRAWAL IS EXPRESSLY EXCLUDED
PURSUANT TO ART. 59 OF LEGISLATIVE DECREE NO. 206/2005 (SO-CALLED CONSUMER CODE) AND SUBSEQUENT AMENDMENTS AND ADDITIONS, THE RIGHT OF WITHDRAWAL IS EXPRESSLY EXCLUDED in cases where the good sold has been made “to measure” or “personalized” based on the choices of the end customer.
